Proposed Law on the Execution of Palestinian Prisoners
The draft law permitting the execution of detainees violates Article 6 of the International Covenant on Civil and Political Rights (ICCPR), as it allows the imposition of the death penalty without judicial unanimity and relies solely on a majority decision, thereby undermining the judicial safeguards required for the application of this irreversible punishment.
The Hague Initiative calls on the Human Rights Committee of the International Covenant on Civil and Political Rights to urge the occupying state — as a party to the Covenant — not to adopt or implement the proposed law, as it constitutes legislation that violates international law and lacks legal and humanitarian legitimacy. The Initiative also urges the United Nations and its Secretary-General, as well as the European Union, to issue a clear position affirming their rejection of the death penalty law for prisoners and to pressure the occupying authorities to halt all measures related to the adoption of the law.
